1. AGREEMENT TO TERMS These Terms and Conditions constitute a legally binding agreement made between you (“User”) and RAZ Business Group LLC, doing business as Party of Four Travel (“Agency,” “we,” “us,” or “our”), a company registered in New York, United States. By accessing the website https://partyof4travel.com (the “Site”), you agree that you have read, understood, and agreed to be bound by these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Site and must discontinue use immediately. The Site is intended for users who are at least 18 years old.

2. INTELLECTUAL PROPERTY RIGHTS Unless otherwise indicated, the Site is our proprietary property. All source code, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks and logos contained therein are owned or controlled by us and protected by copyright and trademark laws. You are granted a limited license to access and use the Site for your personal, non-commercial use. You may not copy, reproduce, or exploit any Content for commercial purposes without our express written permission.

3. PROHIBITED ACTIVITIES You may not access or use the Site for any purpose other than that for which we make the Site available. As a user of the Site, you agree not to:

  • Systematically retrieve data (data mining, robots, scraping) from the Site.

  • Trick, defraud, or mislead us or other users.

  • Use the Site to advertise or offer to sell goods and services without our permission.

  • Engage in unauthorized framing of or linking to the Site.

  • Upload or transmit viruses, Trojan horses, or excessive spam that interferes with the Site’s operation.

4. USER CONTRIBUTIONS & REVIEWS If you post comments, reviews, or contributions to the Site, you grant us an unrestricted, perpetual, royalty-free license to use, reproduce, and display such content. You represent that your contributions do not violate any third-party rights or contain illegal, harassing, or offensive material. We reserve the right to remove any content at our sole discretion.

5. THIRD-PARTY LINKS The Site may contain links to third-party websites (e.g., supplier sites, tourism boards). We do not monitor or control these websites and are not responsible for their content, privacy policies, or practices. Accessing third-party sites is at your own risk.

7. DISCLAIMER & LIMITATION OF LIABILITY THE SITE IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF. IN NO EVENT WILL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SITE.

8. GOVERNING LAW & DISPUTE RESOLUTION These Terms shall be governed by and defined following the laws of the State of New York.

  • Informal Negotiations: Parties agree to attempt to negotiate any dispute informally for at least thirty (30) days before initiating arbitration.

  • Binding Arbitration: Any unresolved dispute shall be resolved by binding arbitration under the rules of the American Arbitration Association (“AAA”). The arbitration will take place in Onondaga, New York. You waive the right to a jury trial or to participate in a class-action lawsuit.

TRAVEL BOOKING TERMS & CONDITIONS

1. AGENCY RELATIONSHIP & SUPPLIER RISKS You understand that RAZ Business Group LLC d/b/a Party of Four Travel (“Agency”) acts solely as a booking agent for third-party suppliers (including, but not limited to, airlines, cruise lines, hotels, tour operators, and transportation providers). We do not own, operate, or control these suppliers. By booking travel, you agree that the Agency is not responsible for the acts, omissions, errors, financial default, or negligence of any third-party supplier.

2. PRICING AND AVAILABILITY All quotes are subject to change and availability until the booking is confirmed and the required deposit or full payment is made.

  • Price Fluctuations: You acknowledge that pricing may change due to supplier demands, fuel surcharges, or government taxes prior to ticketing.

  • Final Payment: You are responsible for strictly adhering to all payment deadlines. Failure to make final payment by the supplier’s deadline may result in the cancellation of your booking and the forfeiture of any deposits paid.

3. CREDIT CARD TRANSACTIONS & CHARGEBACK WAIVER By authorizing the Agency to charge your credit card for travel services, you certify that you are the authorized cardholder.

  • Chargebacks: You agree that you will not initiate a chargeback or credit card dispute against the Agency for any financial loss resulting from a Supplier’s cancellation, delay, or failure to perform. In such events, your recourse for a refund is directly with the Supplier, not the Agency.

  • Authorization: You grant the Agency power of attorney to sign all documents necessary to purchase and issue tickets, insurance, and hotel guarantees on your behalf.

4. CANCELLATION & REFUNDS

  • Supplier Policies: All bookings are subject to the specific cancellation and refund policies of the Supplier. Some reservations may be non-refundable or incur substantial penalties upon cancellation.

  • Agency Fees: In addition to Supplier penalties, the Agency may charge a separate administrative cancellation fee to cover the time and resources invested in your booking.

5. FORCE MAJEURE The Agency shall not be liable for any failure to perform its obligations where such failure is a result of Acts of God (including fire, flood, earthquake, storm, hurricane, or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power, terrorist activities, government sanction, blockage, embargo, labor dispute, strike, lockout, interruption or failure of electricity or telephone service, pandemic, epidemic, or government-mandated travel restrictions.

6. TRAVEL INSURANCE The Agency highly recommends the purchase of travel insurance to protect your investment. You acknowledge that the Agency has advised you of the availability of travel insurance to cover risks such as Trip Cancellation, Trip Interruption, Medical Emergencies, and Lost Baggage.

  • Waiver: If you choose to decline travel insurance, you assume full responsibility for any financial loss associated with your travel arrangements that could have been covered by such insurance.

7. TRAVELER RESPONSIBILITIES & DOCUMENTATION

  • Review: It is your responsibility to review all travel documents immediately upon receipt and notify the Agency of any discrepancies (e.g., names, dates, or birthdates) within 24 hours.

  • Passports & Visas: You verify that you have a valid passport (valid for at least 6 months beyond your return date) and have secured any necessary visas or vaccinations. The Agency is not responsible for denied entry due to lack of proper documentation.

  • Real ID: Beginning May 7, 2025, you must present a Real ID-compliant license or a valid passport to board domestic flights in the U.S.

8. SEVERABILITY & SURVIVAL If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
